PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS PLATFORM.

The following terms and conditions govern and apply to your use of the Kenjgewin Teg Alumni Database Platform (the "Platform").

By accessing or using the Platform, you confirm that you have read, understand, and agree to be bound by these Terms and Conditions and any applicable laws, statutes, and/or regulations.

We may update these Terms and Conditions at any time without notice. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms and Conditions.

1.      INTELLECTUAL PROPERTY

Kenjgewin Teg or its licensors own all intellectual property on the Platform. This includes materials protected by copyright, trademark, and patent laws.

a)      Kenjgewin Teg owns all trademarks, service marks, and trade names associated with the Platform.

b)      All content on the Platform, including but not limited to text, software, code, design, photos, videos, applications, and interactive features, is a collective work under Canadian Copyright Law and is the exclusive property of Kenjgewin Teg.

c)      User-generated content remains the user's property, but by posting content on the Platform, users grant Kenjgewin Teg a non-exclusive, royalty-free, worldwide license to use, modify, distribute and display the content for alumni engagement and networking purposes.

• USE OF PLATFORM MATERIALS

We may provide users with certain information and resources as part of the Alumni Database Platform, including but not limited to documents, data, contact lists, networking tools, and other community engagement materials ("Platform Materials").

a)      These Platform Materials may only be used for personal and professional networking within the alumni community.

b)      Users may not reproduce, distribute, modify, or use Platform Materials for commercial purposes, third-party distribution, or unauthorized research.

c)      Unless explicitly stated, no licences or transfer of intellectual property rights are granted to users.

• USER ACCOUNTS AND RESPONSIBILITY

•  ACCOUNT CREATION AND ACCURACY

a)      To access certain features of the Platform, users are required to create an account.

b)      Users must provide accurate, complete, and up-to-date information.

a)      Kenjgewin Teg is not responsible for issues arising from outdated or incorrect information.

3.2  ACCOUNT SECURITY

a)      Users are responsible for maintaining the confidentiality of their login credentials.

b)      Users must not share account details or allow others to access their accounts.

c)      If unauthorized access is suspected, users must notify Kenjgewin Teg immediately.

3.3  USER CONDUCT AND RESPONSIBILITY

Users agree not to:

a)      Impersonate another person or provide false identity information.

b)      Use another user's account without permission.

c)      Engage in fraudulent activity, such as misrepresenting employment, education or affiliation with Kenjgewin Teg.

d)      Use the Platform for commercial purposes, including advertising, solicitation, or recruitment.

e)      Harass, threaten or harm other users in any way.

3.4  ACCOUNT SUSPENSION AND TERMINATION

a)      Kenjgewin Teg reserves the right to suspend or terminate accounts for violations of these Terms of Use.

b)      Accounts may also be deactivated due to inactivity or misuse.

c)      Upon termination, access to stored information may be permanently revoked, and Kenjgewin Teg assumes no liability for lost data.

• ACCEPTABLE USE

You agree not to use the Platform for any unlawful purpose or any purpose prohibited under this clause. You also agree not to use the Platform in any way that could harm the integrity of the Platform, its users, or the operation of Kenjgewin Teg.

You further agree not to use and/or access the Platform:

a)      To harass, abuse, or threaten others or otherwise violate any person's legal rights.

b)      To violate any intellectual property rights of Kenjgewin Teg or a third party.

c)      To upload, share, or disseminate malicious software, viruses or unauthorized automated tools that may harm the Platform or its users.

d)      To engage in fraudulent activities such as impersonation or misrepresentation.

e)      To use the Platform for unauthorized financial transactions, including gambling, pyramid schemes or soliciting funds.

f)        To post, publish or distribute obscene, defamatory, or false information about individuals or the institution.

g)       To share or promote hateful, discriminatory, or violent content against any group or individual.

h)      To collect, store, or distribute personal information of users without consent or use it for unauthorized purposes such as marketing or spam.

Kenjgewin Teg reserves the right to monitor, suspend, or terminate accounts that violate these terms.

• PROTECTION OF PRIVACY

By using the Platform, you may provide us with personal and professional information, including but not limited to your name, contact information, graduation year, and employment status. By using the Platform, you authorize us to collect, store, and process your information in Canada and any other country where we operate.

We may receive additional information from:

a)      External applications you use to log in or interact with the Platform.

b)      Web technologies such as cookies, log files, clear GIFS and web beacons.

We use this information to:

a)      Ensure a secure and engaged experience on the Platform.

b)      Facilitate networking, communication and alumni engagement.

c)      Improve marketing, analytics and platform functionality, which may involve third-party service providers assisting with outreach analytics.

5.1   DATA RETENTION AND USER RIGHTS

Data Retention: We retain users' information for as long as necessary to fulfill the purpose outlined in this policy, including alumni engagement and institutional communication.

• REVERSE ENGINEERING AND SECURITY

You may not engage in any activity that compromises the integrity or security of the Platform.

Specifically, you agree not to:

a)      Reverse engineer, attempt to reverse engineer or disassemble any software, code, or database structure on the Platform.

b)      Gain authorization access to accounts, data, or systems.

c)      Circumvent or attempt to bypass security measures, encryption or authentication processes.

d)      Conduct data mining, scraping, or automated access without explicit permission.

e)      Disrupt the Platform by overloading servers, introducing malware, or interfering with network operations.

Any attempt to violate these security terms may result in suspension or termination of access and may be subject to legal action.

• INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Kenjgewin Teg, its affiliates, employees, and partners from any and all legal claims, liabilities, and expenses (including reasonable attorneys' fees) arising from:

a)      Your use or misuse of the Platform.

b)      Your breach of these Terms and Conditions.

c)      Your actions or conduct on the Platform, including interactions with other users.

Kenjgewin Teg reserves the right to select its own legal counsel and may participate in its defence if necessary.

• SPAM POLICY

You are strictly prohibited from using the Platform for any form of spam, including but not limited to:

1. Collecting or harvesting email addresses, personal information, or user data without consent.
2. Sending mass unsolicited emails, advertisements, or promotional materials.
3. Engaging in phishing, fraud or deceptive practices using the Platform.

Violations of this policy may result in account suspension or termination and could be subject to further legal action.

• THIRD-PARTY LINKS AND CONTENT

The Platform may contain links to third-party websites, services or content for informational or networking purposes. Kenjgewin Teg does not endorse, control or assume liability for any third-party content, security risks or transactions made through these links.

Users should review the privacy policies and terms of any third-party services before engaging with them.

• VARIATION

If any provision or part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full effect. The most recently updated version of these Terms shall apply.

• SERVICE INTERRUPTIONS

We may temporarily suspend access to the Platform to perform scheduled maintenance, system updates, or emergency fixes. These interruptions may occur with or without notice.

You acknowledge and agree that access may be unavailable at times and that Kenjgewin Teg will not be liable for any losses, data issues, or damage resulting from such downtime. 

• NO WARRANTIES

Use of the Platform is at your sole risk. The Platform and any related services are provided "as is" and "as available." Kenjgewin Teg disclaims all warranties, express or implied, including but not limited to:

a)      Implied warranties of merchantability or fitness for a particular purpose.

b)      Guarantees that the Platform will be secure, error-free or uninterrupted.

c)      Accuracy or reliability of any information obtained through the Platform.

We are not responsible for any data loss, system damage, or other issues that may occur through your use of the Platform. Users are responsible for backing up their own data and ensuring they meet system requirements.

• PRIVACY

You acknowledge that communications and data transmitted over the internet may be intercepted, altered or lost and, therefore, cannot be guaranteed as confidential or secure unless otherwise required by applicable privacy laws.

By using the Platform, you agree that any information submitted electronically, including via email or web forms, may be stored, monitored, or processed in accordance with Kenjgewin Teg's Privacy policies and applicable legislation.

Users are encouraged to avoid transmitting sensitive personal information through unsecured channels and are responsible for maintaining the confidentiality of their login credentials.

• LIMITATION OF LIABILITY

To the fullest extent permitted by law, Kenjgewin Teg will not be held liable for any loss, damages, or inconveniences resulting from your use of the Platform, including but not limited to:

a)      Loss of Data.

b)      Service interruptions.

c)      Errors, omissions, or inaccuracies.

d)      Unauthorized access or data breaches.

The maximum liability of Kenjgewin Teg arising from your use of the Platform is limited to the greater of one hundred ($100) Canadian Dollars or the amount paid by you to Kenjgewin Teg for services through the Platform in the Last six (6) months, if any.

This limitation applies to all claims, including negligence, strict liability, tort, or contract.
